Shipping, Delivery and Pick Up
At this time, CocoaBerry Cake Co. ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, CocoaBerry Cake Co. ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.
We are not responsible for any damage to the cake(s) or desserts after setup is complete and our staff has left the premises. You or the venue are responsible for providing an appropriate and secure table and environment for the cake(s) or desserts. Cake(s) are heavy and require a sturdy table, and optimal room temperature of 75 degrees or below. If the cake(s) or desserts are required to be set up outside of an AC room or in a room that doesn’t have AC we are not responsible for any damages incurred to the cake(s) or desserts due to the heat or environment.
If you or your representative elects to pick up and set up the cake(s) or desserts, you assume all liability and responsibility for the condition of the cake(s) or desserts once it leaves CocoaBerry Cake Co. possession.
For pick up orders, we recommend that cakes be transported on a flat surface in your vehicle (the floor or trunk space) with the air conditioning on high. Cakes should be stored in the fridge, especially prior to any transport and brought to room temperature (around 45 minutes – 1 hour) prior to serving.
Once the order has been picked up CocoaBerry Cake Co. is releasing ALL liability and is not responsible for any damage it may incur during transportation, heat or other factors.
International
Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.
Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. CocoaBerry Cake Co. is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.
Sales Tax
CocoaBerry Cake Co. charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped.

Performance of contact agreement for services and the terms is contingent upon the ability of CocoaBerry Cake Co. to complete the agreement/contract for services is subject to labor disputes or strikes, accidents, Acts of God, weather, Covid-19 related cancelations or circumstances and other causes beyond our control.

We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including, but not limited to, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses, and traffic information.

CAKE ORDERS, CUSTOM CAKES AND EVET SERVICES TERMS AND CONDITIONS:
The following terms apply to custom event cakes, wedding cakes, and consultation-based orders. For Store/Online Orders, please refer to our separate Refund & Cancellation Policy at checkout.
- Your initial deposit reserves your event date, covers all administrative, consultation, research, and design time invested, and is non-refundable.
- We must receive the balance by the due date indicated. Failure to remit payment by the due date will result in cancellation of the order and forfeiture of all monies paid unless a written extension request is approved by CocoaBerry Cake Co. Payment extensions cannot extend past three (3) weeks prior to the event date.
- The final payment date is also the final date for any changes to the size, design, colors, flavors, or other details of the order. Changes requested after this date cannot be guaranteed and may be subject to additional charges.
- Delivery and setup fees begin at $75 and are subject to increase based on location, mileage, venue access requirements, setup complexity, and delivery timing.
- Client grants CocoaBerry Cake Co. permission to be identified as the cake designer and participating event vendor in event publications, vendor lists, and social media posts whenever reasonably possible.
- CocoaBerry Cake Co. must receive the complete vendor contact list for the event and be included as a participating vendor.
- Client agrees to provide CocoaBerry Cake Co. with professional photographs of the cake(s) or desserts where a professional photographer is present at the event. Client agrees to make reasonable efforts to provide access to these photographs or to connect CocoaBerry Cake Co. directly with the event photographer. Client grants CocoaBerry Cake Co. permission to use such photographs for promotional, marketing, website, portfolio, and social media purposes without compensation.
- On occasion, CocoaBerry Cake Co. may also photograph its own cakes and desserts independent of any event photographer. We reserve the right to use any such photographs for display, publication, advertising, portfolio, website, social media, and promotional purposes without compensation to the Client.
- Client or designated representative is responsible for inspecting all products upon delivery or pickup. Acceptance of the order confirms that all products were received in satisfactory condition.
- CocoaBerry Cake Co. is not responsible for any damage to the cake(s) or desserts after setup is complete and our staff has left the premises. You are responsible for providing a sturdy, level, and secure table and a suitable environment. Cakes are heavy and require proper support. Optimal room temperature is 75°F or below. If cakes or desserts are displayed outdoors or in a non-air-conditioned environment, CocoaBerry Cake Co. is not responsible for any resulting damage. CocoaBerry Cake Co. reserves the right to delay, modify, or refuse setup if environmental conditions are deemed unsafe for the cake(s) or desserts.
- CocoaBerry Cake Co. is not responsible for damage caused by venue staff, caterers, guests, photographers, planners, transportation providers, or any other third party after delivery, pickup, or setup is completed.
- If you or your representative elects to pick up and transport the cake(s) or desserts, you assume all liability and responsibility for the condition of the products once they leave CocoaBerry Cake Co.’s possession.
- While every effort will be made to replicate inspiration photos and design concepts, CocoaBerry Cake Co. does not guarantee exact duplication of any cake, dessert, color, flower, or artistic element. Variations are inherent in handmade products.
- Inspiration images generated by artificial intelligence (AI) are not a guarantee of feasibility in fondant, buttercream, or other edible mediums. AI-generated designs often include visual effects, textures, or density of detail (such as glow effects, fine-line patterning, or exact logo/typography reproduction) that cannot be physically replicated by hand. CocoaBerry Cake Co. will interpret and translate the general concept and aesthetic of an AI-generated reference but does not guarantee exact or pixel-level duplication. Recreation of complex custom artwork, logos, or branding elements beyond standard design scope will incur an additional design fee, quoted separately from the cake price and due prior to design work beginning. To help avoid additional fees, CocoaBerry Cake Co. may request that the Client provide all AI-generated artwork, logo files, and design references in full at the time of booking. Design revisions for AI-inspired or highly complex custom artwork are limited to two (2) rounds of revisions; additional revision rounds will incur further design fees. Extensive design consultation, artwork development, or logo recreation for custom or AI-inspired designs will not begin until a deposit is received, except at CocoaBerry Cake Co.’s sole discretion.
- Exact color matching cannot be guaranteed due to differences in edible mediums, lighting conditions, printed materials, fabrics, flowers, photography, and digital displays.
- Serving recommendations are based on industry-standard serving sizes. Actual servings may vary depending on how the products are cut and served.
- You acknowledge that fresh flowers are not a food product and may contain pesticides, insects, dirt, bacteria, or other contaminants. CocoaBerry Cake Co. assumes no responsibility for issues arising from the use of fresh flowers.
- Our products may contain or come into contact with milk, eggs, wheat, soy, peanuts, tree nuts, and other allergens. Client agrees to notify guests of this risk and releases CocoaBerry Cake Co. from liability related to allergic reactions or food sensitivities.
- Performance of this agreement is contingent upon the ability of CocoaBerry Cake Co. to complete the order and is subject to labor disputes, strikes, accidents, severe weather, natural disasters, pandemics, public health emergencies, government restrictions, transportation interruptions, acts of God, and other circumstances beyond our control. In such circumstances, liability shall be limited to a refund of monies paid, less any non-recoverable expenses already incurred.
- Tiered cakes contain support structures, including dowels and support rods. These items must be removed prior to serving and are not edible.
- Flowers, toppers, decorative elements, and custom design pieces may be attached using floral wire, toothpicks, skewers, or other support materials. These items must be removed before serving and are not edible.
- All payments made to CocoaBerry Cake Co., including deposits and final payments, are non-refundable and non-transferable. If the Client cancels the order after booking, CocoaBerry Cake Co. reserves the right to retain all payments received to cover administrative, design, labor, and material costs incurred.
- Orders not picked up on the agreed pickup date and time may be discarded after twenty-four (24) hours without refund.
- Any concerns regarding the quality or condition of products must be reported within twenty-four (24) hours of delivery or pickup. Photographs of the alleged issue must accompany any claim whenever possible. Failure to do so constitutes acceptance of the products as satisfactory.
- In the unlikely event that CocoaBerry Cake Co. is found liable for any claim arising from this agreement, liability shall be limited to the total amount paid by the Client under this agreement and shall not include consequential, incidental, emotional distress, special, indirect, or punitive damages.
- Client agrees not to initiate a chargeback or payment dispute for products delivered or services performed under this agreement without first providing CocoaBerry Cake Co. a reasonable opportunity to resolve the matter.
- This agreement shall be governed by and construed in accordance with the laws of the State of California.
- By submitting payment, approving an invoice, confirming an order via email, text message, website inquiry, social media message, electronic communication, or otherwise authorizing CocoaBerry Cake Co. to proceed with the order, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions. Such approval, authorization, or payment shall be deemed the equivalent of a handwritten or electronic signature and shall constitute acceptance of this agreement in its entirety.
ACKNOWLEDGMENT:
By submitting payment, approving this invoice, or authorizing CocoaBerry Cake Co. to proceed with this order, Client acknowledges that they have read, understood, and agree to these Terms and Conditions available at www.cocoaberrycake.com.
